    Have You Ever Signed a Noncompete?Noncompetes in the US are still legally enforceable under some circ*mstances, but the legal trend for noncompetes is that they are hard to enforce, especially against lower-wage workers. One reason for this legal trend is that there is more of a power disparity between an employer and a lower-wage worker, compared to a high-earning executive who likely has the ability to negotiate their employment terms.My firm, Lipp Law, helps companies and executives with noncompete issues throughout DC, Maryland, and Virginia - so we review and draft noncompetes regularly to protect our clients. We also get involved in noncompete disputes, cease and desist letters and responses, and noncompete litigation.Among DC, Maryland, and Virginia, DC has the most restrictive noncompete laws. In 2022, DC passed a new noncompete law stating that anyone making less than $150K cannot be held to a noncompete ($250K for medical specialists). DC's noncompete law is not retroactive, meaning that noncompetes signed before the law went into effect can still be enforced.Virginia and Maryland have banned noncompetes for lower-wage workers.     The proposed time-limit on non-competes is intended to help promote market mobility and, in theory, should drive wages up - employees will be able to move on more easily, encouraging employers to boost salaries for both retention and recruitment purposes. But it remains to be seen whether employers might look to restrain employees in other ways, by implementing longer notice periods and garden leave.It will also be interesting to see what approach is taken by the legislature in implementing this time-limit. Will it only impact future non-competes? Or will it have a retrospective effect on existing non-competes, capping them at three months or even voiding them entirely?

    Most people know that California doesn't enforce non-competes. But as of January 1, California prohibits employers from even including non-competes in an employment contract.The new law also requires employers to give current CA employees written notice--by February 14--if they signed an agreement with void noncompete provisions, and to certain former California employees.The notice must be individualized and delivered to the last known address and email address of the employee or former employee.Learn more in this “LaborSphere” blog by my Faegre Drinker colleagues Mark Terman and Erik Mosvick.#EmploymentLaw #HR #Employers #California #Noncompete #LaborSphere

    Regarding Non-compete clauses...CA has long put restrictions on non-compete clauses in employment agreements. Now, the state has passed a law prohibiting CA employers from “honoring” non-compete contracts that were entered into in another state. In passing this law, research indicated that California employers have continued to have their employees sign noncompete clauses that are clearly void and unenforceable under California law. Another law under consideration, AB 1076, would require employers to notify current and former employees in writing that any noncompete agreements they may have signed are void.     "MOST NON-COMPETE AGREEMENTS BANNED IN MN"Know your rights. As a former employee now employer it's easy to switch a position based on which way it benefits us personally. But after now seeing this issue first hand and from both sides, I agree with the MN governor and legislation to ban most noncompetes. There are exclusions which seem reasonable. Its my experince that some business owners use fear to control employees instead of continuously improving the worker experience and incentives in the workplace. Non competes can be the lazy man's way of keeping good and ambitious workers handcuffed to your business.#steel #MN #businessowners #employeeappreciation
